Agreement
By accessing or using MERCHcore ("the Service"), you agree to be bound by these Terms of Service. MERCHcore is a merchandise point-of-sale platform operated by Jeremy Swan and Zack Arnett. If you do not agree to these terms, do not use the Service.
The Service
MERCHcore provides a mobile-first point-of-sale system for bands to sell merchandise at live shows. The platform includes inventory management, real-time sales tracking, SMS notifications, seller management, and profit-and-loss reporting. The Service is provided "as is" and may be updated, modified, or discontinued at any time.
Accounts
You must provide a valid phone number to create an account. You are responsible for all activity under your account. Band leaders are responsible for the sellers they invite to their band. You must not share your login credentials or allow unauthorized access to your account.
Fees
MERCHcore charges a platform fee on sales processed through the Service. The current fee structure is 3% on all sales, in addition to payment processing fees. Fee rates are subject to change with notice. Detailed fee breakdowns are visible in the band leader dashboard for full transparency.
Sales & Transactions
All sales recorded through the Service are final and immutable. MERCHcore is not responsible for disputes between bands, sellers, and customers. Band leaders are responsible for the accuracy of their inventory, pricing, and tax compliance. MERCHcore does not collect or remit sales tax on behalf of bands.
SMS Communications
By using the Service, you consent to receive SMS messages related to your account, including authentication codes, sale alerts, and show summaries. Standard message and data rates may apply. You may opt out of non-essential messages by replying STOP. See our Privacy Policy for more details.
Intellectual Property
MERCHcore is the intellectual property of Jeremy Swan and Zack Arnett. You retain ownership of your content (band info, merch photos, sales data). By uploading content to the Service, you grant MERCHcore a license to store, display, and process that content as needed to operate the platform.
Limitation of Liability
MERCHcore is not liable for lost revenue, missed sales, SMS delivery failures, inventory discrepancies, or any indirect damages arising from use of the Service. Our total liability is limited to the fees you have paid to MERCHcore in the preceding 12 months.
Termination
Either party may terminate at any time. Upon termination, your access to the Service will be revoked. Sale records and financial data will be retained as required for reporting and compliance purposes.
